By accessing our website, viewing our architectural cinema presentations, or utilizing our virtual reality and real-time visualization services, you confirm that you are at least 18 years of age, possess the legal authority to enter into a binding agreement, and agree to comply with all applicable local, national, and international laws and regulations.

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will post the most current version on this page with an updated "Last Updated" date. Your continued use of the website or services following any amendments constitutes your formal acceptance of the new Terms.

- Nature of Digital Deliverables: All architectural renderings, 3D animations, digital twins, interactive virtual reality (VR) walkthroughs, and immersive spatial environments produced by Blue Onyx Estates are created for conceptual, marketing, and visualization purposes.

- Design Variations: Due to differences in hardware specifications, display calibration, real-time rendering engines, and continuous design evolution, the final delivered digital environments or physical builds may exhibit minor variances from preliminary proofs or pre-visualizations.

- Informational and Artistic Scope: Visual assets, cinematic flythroughs, and interactive VR applications do not constitute a formal structural engineering guarantee, architectural blueprint, or legal zoning warranty. Clients and end-users are responsible for verifying all final engineering and construction documents through licensed structural professionals prior to physical execution.

- Project Estimates and Proposals: All custom architectural visualization and VR development projects require a formal, agreed-upon project proposal or statement of work (SOW) outlining the scope, milestones, and associated fees before work commences.

- Deposit Requirements: A non-refundable initial deposit (typically 50% of the total project fee, unless otherwise specified in your SOW) is required prior to the initiation of any 3D modeling, rendering, or development work.

- Milestone Payments and Invoicing: For multi-stage projects, milestone payments must be cleared before subsequent phases (such as high-resolution rendering passes, interactive VR deployment, or final asset handover) begin. Invoices are payable upon receipt or within the net terms explicitly stated on the invoice.

- Late Payments: Failure to settle outstanding balances by the due date may result in the suspension of ongoing project work, withholding of source files and final deliverables, and the application of late fees or statutory interest where permitted by law.

- Revisions and Out-of-Scope Work: Project pricing includes a specified number of revision rounds as detailed in your proposal. Additional revisions, scope changes, or supplementary model adjustments requested outside the agreed-upon brief will be billed separately at our standard hourly or project rates.

If you create an account or access a dedicated client portal to review interactive VR builds or high-resolution cinematic sequences, you are responsible for maintaining the strict confidentiality of your account credentials, access keys, and passwords.

You agree to accept full responsibility for all activities and stream sessions that occur under your account.

You must notify us immediately upon becoming aware of any unauthorized access to your project files or security breach.

All digital content, 3D assets, source models, shaders, lighting setups, cinematic sequences, VR applications, and proprietary project files produced by Blue Onyx Estates remain the exclusive intellectual property of Blue Onyx Estates unless explicitly assigned via a separate, signed commercial licensing agreement.

Clients are granted a limited, non-exclusive license to use the delivered visualizations strictly for the agreed-upon marketing, presentation, or project scope, conditional upon full payment of all applicable fees. Unauthorized extraction, reverse engineering, redistribution, or commercial reuse of our 3D assets and software packages is strictly prohibited.

When using our website, client portals, and interactive VR services, you agree not to:

- Violate any applicable local, state, federal, or international laws or regulations.

- Attempt to decompile, disassemble, reverse engineer, or extract source code, proprietary shaders, or raw 3D assets from our virtual reality applications or web viewers.

- Use any automated device, robot, spider, or script to scrape, crawl, or extract data or digital assets from our platform.

- Attempt to gain unauthorized access to, interfere with, damage, or disrupt any cloud servers, streaming nodes, or databases connected to Blue Onyx Estates.

- Misrepresent your identity or affiliation with any person or entity.

To the maximum extent permitted by applicable law, Blue Onyx Estates, its directors, employees, partners, agents, suppliers, or affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages—including but not limited to loss of project revenue, data corruption, rendering hardware failure, or business interruption—resulting from:

- Your access to or use of (or inability to access or use) our visualization tools, web portals, or VR experiences;

- Any technical incompatibility between our real-time applications and your local hardware, VR headsets, or display equipment;

- Any design or real estate investment decisions made based exclusively on pre-visualization media.

You agree to defend, indemnify, and hold harmless Blue Onyx Estates and its licensees, licensors, employees, contractors, agents, officers, and directors from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including attorney's fees) arising from your use of the Service, violation of these Terms, or violation of any rights of a third party.

These Terms shall be governed and construed in accordance with the laws of the jurisdiction in which Blue Onyx Estates primarily operates, without regard to its conflict of law provisions. Any legal action or proceeding arising out of these Terms shall be brought exclusively in the local or federal courts situated within that jurisdiction.
